Areas of Expertise

The professionals at this firm work in defending defendants and those under investigation in criminal proceedings; in prosecution, representing victims of crimes; and in providing criminal legal advice of various kinds, not related to prosecution or defense, but connected to criminal law.

Although traditional criminal defense focuses on defending the accused, we also act as prosecutors, representing the interests of individuals and legal entities who are victims of crimes. To address the business aspects of these cases, our team has also specialized in internal investigations and compliance, with expertise in the pre-trial phases of internal investigations and audits, assisting in the investigation of facts and the collection of evidence that will later be used in criminal proceedings.

Areas of Expertise

Our professional practice covers the following areas.

Thus understood are crimes against the National Financial System (Law No. 7,492/86), money laundering crimes (Law No. 9,613/98 and its subsequent amendments), tax evasion and crimes against the economic order (Law No. 8,137/90), crimes in bidding and administrative contracts (Law No. 14,133/21), crimes of fraud, embezzlement, simulated duplicate invoices, fraud against creditors and other illicit acts.

These are typically crimes under the jurisdiction of the Federal Courts or specialized courts, such as the 1st and 2nd Specialized Courts for Tax Crimes, Organized Crime, and Money Laundering in the capital of São Paulo, and require contentious action in proceedings and in personal and property precautionary measures.

We consider business-related claims to be all those involving criminal matters related to the business activities of legal entities, whether they are advisory, contentious, or require legal support.

Business consulting services encompass legal opinions and advice on operations that may have criminal consequences. They also include monitoring and conducting internal investigations and audits in cases of irregularities involving managers, employees, and suppliers.

Business litigation encompasses the defense of partners, directors, and employees of legal entities in investigations and criminal proceedings related to business activity. We also act as representatives of victims, identifying crimes and promoting the accountability of perpetrators. In both cases, these claims typically involve property crimes, crimes against consumer relations, environmental crimes, unfair competition crimes, copyright infringements, crimes against honor, among others.

Business legal support demands encompass situations that don't fit into the previous categories, where corporate clients, despite not being victims or defendants, need to respond to demands and requests from the Judiciary, Public Prosecutor's Office, and Judicial Police. Through this service, we ensure the integrity, accuracy, and effectiveness of transmitted information, the timely fulfillment of requests, the minimization of risks, and the avoidance of unnecessary conflicts with public and private entities.

Our partners began their careers in renowned law firms and have been practicing criminal law for over 30 years. Much of this experience has been spent working on classic cases, investigating and prosecuting individuals for crimes against property, life, public trust, and others.

We have a special relationship with the Jury Court, built through consistent work and the handling of over 150 jury trials. Among these, we highlight our firm's decisive and successful role in the longest jury trial in the history of the Brazilian Federal Justice system, which took place in 2022 and lasted 18 days.

Our expertise in classic criminal law is part of our firm's DNA, and it has helped us build a human relationship with all actors in the judicial system, whether they are defendants, victims, judges, or court staff. It was this background that led us to the handcrafted and individualized format of our current structure.

The evolution of Brazilian criminal and procedural law has brought with it new situations that, by their nature, can be classified as classic cases and are also handled by our firm. These include situations involving the application of the Maria da Penha Law, both in defense of the accused and the victims, urgent protective measures, and the crime of stalking (stalkingAlso noteworthy are crimes against honor (slander, defamation, and libel), which have taken on a broader scope with the popularization of social media and the spread of offenses through this medium.

With the expansion of criminal law and the increased implementation of restrictive sentences involving imprisonment, our professionals have identified a gap in the legal market: acting in criminal enforcement proceedings has never been an area of interest for law firms specializing in criminal law.

Our firm, in contrast, has always worked on criminal enforcement proceedings, initially on a voluntary basis and later as one of its specialties. Due to this constant involvement, we have developed experience and knowledge in the field, both in judicial and administrative matters, including the application of the legal concepts of sentence reduction and pardon, which have a considerable impact on the final sentence to be served.
